1. Agreement to These Terms

These Terms of Service (“Terms”) are a legal agreement between you and QPO Energy, LLC d/b/a MeterHome (“MeterHome,” “we,” “us,” or “our”) and govern your access to and use of the website located at www.meter-up.com and any related pages, forms, phone calls, emails, and text messages we provide (together, the “Site” and “Services”).

By accessing or using the Site, submitting information through any form on the Site, calling or texting us, or opting in to receive messages from us, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site or Services.

Please read Section 15 (Dispute Resolution and Arbitration) carefully. It requires most disputes to be resolved by individual binding arbitration and limits your ability to bring or participate in a class action.

MeterHome is the registered trade name of QPO Energy, LLC. We operate the websites www.meter-up.com and www.meterhome.com; both are ours, and messages you receive from us may reference either address. We are not a utility, and we are not affiliated with, endorsed by, or acting on behalf of any government agency.

3. Eligibility to Use the Site

You may use the Site only if you are at least 18 years old and legally able to enter into a contract. If you are submitting information about a property, you represent that you are the property owner or are authorized by the owner to request service for that property.

The program is available to homeowners throughout the United States. Whether a particular property qualifies — and how much of the cost is funded — depends on the utility, energy-efficiency program, and incentives available in that area. Eligibility, equipment options, funding levels, and program rules therefore vary by location and may change at any time, and not all areas qualify.

4. About the MeterHome Program

MeterHome offers home battery backup systems that supply power to a home during a utility outage. In many service territories, all or part of the cost of the system and installation is funded through a utility, energy-efficiency administrator, or similar program, and we may earn revenue by making stored energy available to the utility or grid operator during periods of high demand.

You understand and agree that:

  • Eligibility checks are not offers. Submitting your address or other information through the Site allows us to evaluate whether a property may qualify. Any result, estimate, price, incentive amount, or savings figure presented on the Site or by our representatives is an estimate only, is not a binding offer, and does not guarantee that you will qualify or that any particular amount will be funded.
  • Program terms are set by third parties. Funding levels, eligibility rules, equipment options, and program availability are established by utilities, program administrators, and other third parties, and may change or end at any time without notice to you.
  • A separate agreement governs installation and service. If you move forward, the battery system, its installation, ownership, warranty coverage, monitoring, maintenance, any participation in grid services or demand-response programs, and any customer payment obligations will be governed by a separate written customer agreement between you and us (or an affiliate or authorized installer). If there is a conflict between that agreement and these Terms with respect to the equipment or installation, that agreement controls.
  • Installation depends on site conditions. Final eligibility may depend on an on-site assessment, electrical panel capacity, permitting, utility approval, and interconnection approval.
  • No electrical or professional advice. Content on the Site is general information only and is not electrical, engineering, financial, tax, or legal advice.

5. Information You Submit

You agree that all information you submit through the Site — including your name, address, email address, and phone number — is accurate, current, and complete, and that the phone number you provide is a number you own or are authorized to provide. You agree to notify us promptly if your phone number changes or is reassigned.

You are responsible for all activity conducted through your submissions. We may verify, correct, or decline to act on information we believe to be inaccurate, incomplete, or fraudulent.

6. Consent to Be Contacted

By submitting your phone number through the Site or otherwise providing it to us, you agree that MeterHome and the installers, contractors, and service providers acting on our behalf may contact you at that number — including by phone call, prerecorded or artificial voice message, automatic telephone dialing system, and text message — regarding your inquiry, your eligibility, scheduling, installation, and your account.

Consent to receive automated calls or text messages is not a condition of purchasing any product or receiving any service. You may decline automated contact and still request service by calling us at 877-220-3852.

You may withdraw your consent at any time. To stop text messages, reply STOP to any message from us (see Section 7). To stop calls, tell the representative you speak with, or email Sales@meterhome.com. We will honor your request within a reasonable time and, in any event, no later than 10 business days after receiving it. You may also revoke consent by any other reasonable means, including replying to a text message with words such as STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT.

7. SMS Terms and Conditions

This Section 7 is the complete terms and conditions for the MeterHome text messaging program.

7.1 Program Description

Program name: MeterHome Alerts, operated by QPO Energy, LLC d/b/a MeterHome.

If you opt in, you will receive customer service, account, and follow-up text messages from MeterHome, including:

  • eligibility and application follow-up regarding a request you submitted;
  • appointment scheduling, confirmations, and reminders;
  • installation, service, and technician-arrival updates;
  • account and service notifications; and
  • responses to questions you send us.

Some messages may be sent using an automated system. We do not sell your information, and we do not send text messages on behalf of unrelated third parties.

7.2 How to Opt In

You may opt in by checking the SMS consent box on a form on the Site, by providing your mobile number to a MeterHome representative and agreeing to receive texts, or by texting us first. Your consent is limited to the purposes described in Section 7.1.

Consent to receive text messages is not a condition of purchase or of receiving any service.

7.3 Message Frequency

Message frequency varies and depends on your interaction with us. Most subscribers receive fewer than 5 messages per month. You may receive more while your eligibility request, scheduling, or installation is active, and fewer at other times.

7.4 Cost

Message and data rates may apply. MeterHome does not charge for the messages themselves, but your mobile carrier’s standard message and data rates apply to every message sent to or from you. Contact your wireless provider for details about your plan.

7.5 How to Opt Out

To stop receiving text messages at any time, reply STOP to any message from us. You will receive a single confirmation message, and then no further texts will be sent to that number from this program. You may also opt out by calling 877-220-3852 or emailing Sales@meterhome.com. We honor opt-out requests within a reasonable time and no later than 10 business days after receipt.

We also honor other reasonable opt-out words, including QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, and OPT OUT. Opting out of text messages does not withdraw any separate consent you have given to be contacted by phone or email, and does not cancel any service agreement.

7.7 Carriers and Delivery

Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, Boost Mobile, MetroPCS, and others; carriers are not required to participate, and supported carriers may change without notice.

7.8 Age and Authority

You must be at least 18 years old and the owner or authorized user of the mobile number you provide in order to opt in.

7.9 Changed or Reassigned Numbers

If you give up, change, or transfer a mobile number that you opted in with, you agree to notify us promptly by replying STOP from that number, or by contacting us using the information in Section 7.6, so that we do not message a subsequent user of that number.

7.10 Privacy

Information collected through the text messaging program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with the messaging vendors and aggregators that carry the messages on our behalf.

7.11 Changes to the Program

We may modify, suspend, or terminate the text messaging program, or these SMS Terms, at any time. Material changes will be posted on this page with an updated “Last Updated” date. Your continued participation after a change takes effect constitutes acceptance of the change.

8. License to Use the Site

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial purposes.

All content on the Site — including text, graphics, logos, images, photographs, video, software, and the “MeterHome” and “MeterUp” names and logos — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, republish, frame, scrape, distribute, sell, license, or create derivative works from any part of the Site without our prior written permission.

9. Prohibited Conduct

You agree not to:

  1. use the Site for any unlawful, fraudulent, or deceptive purpose, or to submit another person’s information without authorization;
  2. use any robot, spider, scraper, or automated means to access, monitor, or copy the Site;
  3. interfere with or disrupt the Site, its servers, or its networks, or attempt to bypass any security or access control;
  4. reverse engineer, decompile, or attempt to derive the source code of any part of the Site;
  5. upload or transmit viruses, malware, or any other harmful code;
  6. harvest or collect information about other users; or
  7. use the Site in a way that violates any applicable law or regulation, including telemarketing, privacy, and consumer protection laws.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms.

10. Third-Party Websites, Utilities, and Contractors

The Site may contain links to third-party websites and may reference utilities, program administrators, manufacturers, and independent installers. We do not control and are not responsible for the content, products, services, privacy practices, or acts and omissions of any third party. Any dealings you have with a third party are solely between you and that third party.

11. Text Message, Email, and Call Recording Notice

Calls with our representatives may be monitored or recorded for quality assurance and training purposes. Text message conversations are retained as part of our customer service records. By continuing a call or text conversation with us, you consent to this monitoring, recording, and retention.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (b) ANY INFORMATION, ESTIMATE, ELIGIBILITY RESULT, INCENTIVE AMOUNT, OR SAVINGS FIGURE PRESENTED ON THE SITE IS ACCURATE, COMPLETE, OR WILL BE ACHIEVED; OR (c) ANY TEXT MESSAGE, EMAIL, OR CALL WILL BE DELIVERED OR DELIVERED ON TIME.

Nothing in this section limits any warranty expressly provided in a separate written customer agreement for equipment or installation, or any warranty that cannot be disclaimed under applicable law. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER MeterHome NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR ACCESS TO THE SITE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (b) ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply to your use of the Site and Services and do not limit remedies expressly provided in a separate written customer agreement for equipment or installation. Some jurisdictions do not allow the limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless MeterHome and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your breach of these Terms; (c) information you submit, including a phone number you were not authorized to provide; or (d) your violation of any law or the rights of any third party.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

15.1 Informal resolution first. Before starting an arbitration or other proceeding, you agree to first send us a written notice describing the dispute and the relief you seek to Sales@meterhome.com or to the address in Section 2, and to give us 60 days to resolve it informally. Both parties agree to negotiate in good faith during that period.

15.2 Agreement to arbitrate. If the dispute is not resolved informally, you and MeterHome agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Services, our text messages, calls, or emails, or the relationship between us — including claims under the Telephone Consumer Protection Act — will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, and not in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

15.3 Class action and jury trial waiver. You and MeterHome waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person and may not preside over any form of class or representative proceeding. If this paragraph is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court, and the rest of this Section 15 will remain in effect.

15.4 Arbitration procedure. The arbitration will be conducted by a single arbitrator. Unless you and we agree otherwise, the arbitration will take place in the county where you live or by telephone or videoconference, or in Washington County, Oregon. The arbitrator may award any relief available in an individual action in court, but may not award relief to or against anyone who is not a party. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.

15.5 Fees. Payment of filing, administration, and arbitrator fees will be governed by the AAA rules. Each party is responsible for its own attorneys’ fees unless the arbitrator awards them under applicable law.

15.6 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect intellectual property rights or to stop unauthorized access to the Site.

15.7 Your right to opt out of arbitration. You may opt out of this arbitration agreement by sending written notice to Sales@meterhome.com, or to the address in Section 2, within 30 days of the date you first accept these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration. Opting out of arbitration will not affect any other part of these Terms, and will not affect your use of the Site or Services.

15.8 Survival. This Section 15 survives termination of these Terms and your use of the Site.

16. Governing Law and Venue

These Terms and any dispute arising out of them are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 15. For any dispute not subject to arbitration, you and MeterHome consent to the exclusive jurisdiction and venue of the state and federal courts located in Washington County, Oregon. Nothing in these Terms limits any non-waivable right or remedy available to you under the consumer protection laws of the state where you live.

17. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the “Last Updated” date above and post the revised Terms on this page. Changes take effect when posted. Your continued use of the Site after that constitutes acceptance of the revised Terms. If you do not agree, stop using the Site.

18. Termination

We may suspend or terminate your access to the Site or Services at any time, for any reason, with or without notice. Sections 5, 6, 12, 13, 14, 15, 16, and 19 survive any termination.

19. General Terms

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site, and supersede any prior understandings on that subject. Any separate written customer agreement for equipment or installation remains in effect according to its own terms.

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms, in whole or in part, to any affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, severe weather, utility or grid failures, labor shortages, supply chain disruption, government action, or network or carrier outages.

Notices. We may provide notices to you by email, text message, or posting on the Site. Notices to us must be sent to the contact information in Section 2.

Headings. Section headings are for convenience only and do not affect interpretation.
